Borrower's Agreement (Terms and Conditions)

Share & Repair lends items from our Library of Things in exchange for a small fee.

These terms and conditions apply to anyone who borrows items from the Share and Repair Library of Things. They explain what you can expect from us, what we can expect from you, and what to do if something goes wrong whilst using our Library of Things.

By borrowing an item or items from the Library of Things you will be deemed to have read and agreed to these terms and conditions. 

We reserve the right to change these terms and conditions at any time, and you agree to abide by the most recent version of this Borrower’s Agreement each time you borrow from the Library of Things.


What you can expect from us:


Share & Repair provides a range of items that you may borrow for a small fee through its Library of Things.


Items have a fee for borrowing. These fees will be clearly listed on the Library of Things website. 


 We aim to offer a range of items for borrowing, but we cannot guarantee the availability of any particular item or the variety of items. We can remove any item from the Library of Things for any reason and at any time.

Library of Things is responsible for:

  1. Taking reasonable action to ensure the quality and safety of its Things including ensuring they have a valid PAT test where appropriate.

  2. Providing public liability insurance for hiring Things to Members and making clear that this only covers Members when they are using Things for personal use. Insurance does not apply if Members lend or rent Things to other people. Only members are permitted to use any items borrowed.

  3. Handling any issues and complaints relating to borrowing in a timely manner, including making a direct refund to a Member's payment method if for any reason the Member has been overcharged for the Thing borrowed. 

  4. Storing all Member data as securely as reasonably possible, handling data sensitively and ensuring data is compliant with the General Data Protection Regulation and other data protection laws. See the Library of Things Privacy Policy below for more information on how we do this.

  5. The Library of Things reserves the right to reject a reservation when deemed to be against Member responsibilities, our mission and/or values and will clearly communicate our reasons for doing so. This includes if you have previously breached these terms and conditions or if The Library of Things has reason to suspect that you have or will do so.


What we expect from you:


By borrowing an item or items from the Library of Things, you will be deemed to have agreed to these terms and conditions and will pay any amount that is charged for borrowing the item or items.

We can refuse to lend you any item from the Library of Things or end your borrowing if you cannot or do not agree to and comply with all of these terms and conditions

Only Members are eligible to borrow items.You can borrow items by making a booking for the item on the Library of Things portal on our website at https://bathlibraryofthings.org.uk. You can also reserve items by coming into our shop.


 You need to pay a fee to borrow an item. The amount of the fee varies depending on how long you want to borrow the item for and your membership type. You can find the fee that you need to pay listed next to the item on our website.


Prior to borrowing items you must:

 (a) sign up for a membership via the website

 (b) have your residence and ID confirmed by a volunteer or member of the staff

 (d) Pay the appropriate membership fee and the loan fee to borrow an item. Borrowing fees pay for staff, item maintenance, replacement parts, new items and upkeep of our facilities.

(e) bring ID or the details of the booking reference when you come to collect your loan. 


You affirm that the information provided on the Membership Application is current, true, and correct. You understand that this information may be subject to verification.


You must be over 18 to borrow an item from the Library of Things. No-one under 18 may use any electrical items, hardware or tools borrowed from the Library of Things.

 You agree that we can amend or cancel a booking if needed. If this happens, we will notify you of the amendment or cancellation and the reason for it as soon as is reasonably possible. We will also give you a refund of any borrowing fee you have already paid.

 You agree to treat our volunteers and staff with respect when visiting the Share & Repair shop (at 3 York Buildings, George Street, Bath, BA1 2EB, United Kingdom) and whilst using the Library of Things.

By taking possession of any item you warrant and represent to Share and Repair that:

  1.  you have no mental or physical incapacity that would affect your ability to use the item safely

  2.  you are experienced in using the item 

  3. You are capable of using the item in a safe and proper manner.


Only the Member is authorised to use Library items. You shall not permit the use of items checked out by you by any other person unless by express permission of Share and Repair.


You agree to use any items you borrow from the Library of Things in a safe and responsible manner and in a way consistent with the item’s intended purpose. If an item comes with an instruction manual or guide, you agree to follow the manual or guide’s instructions on use.

 When using any item borrowed from the Library of Things, you agree to use it only with any personal protective equipment and/or other safety equipment that may be appropriate.

You agree to report any fault in any item you borrow from the Library of Things to Share & Repair as soon as is practicably possible.

You agree to pay for the loss of, or damage to, any item and while normal wear and tear is to be expected, it does not necessarily exempt members from accruing repair fees. You further agree to accept Share and Repair’s assessment of the condition of returned items and of fair restitution for damage, delinquency and/or loss of items in part or in total. This restitution amount could equal the replacement cost of the item plus a handling and processing fee.


You agree that Share and Repair is not responsible for any manufacturing defects in any borrowed items. Each time you take an item out you must check it visually before you take it, and make other checks for any faults that you may be able to identify before using it. 


You agree that if any borrowed item becomes unsafe or in a state of disrepair, you must immediately discontinue use of the item and notify Share and Repair on return. Share and Repair will only be liable to you for loss or damage caused by our negligence in failing to tell you about a known fault. We will not be liable for faults of which we are not aware. Other than this Share and Repair exclude all liability for death or personal injury caused by our negligence or breach of contract.


When borrowing electrical equipment, you must check the visible wires and plug for any damage before use. If you are using the item outside, moving it about, or using it in circumstances where it may encounter water, anything sharp or other electrical wiring, a circuit breaker must be used. The Member must take ALL necessary precautions when using the borrowed item. 


You agree to treat any items borrowed from the Library of Things with reasonable care and return them in clean and working condition, as far as this is reasonably practicable.

All fines and fees must be paid in full before you can borrow additional items. We reserve the right to change late fees under extreme circumstances.



What to do if something goes wrong:


The items in our collection are for the use of The Library of Things members. Out of respect for future users, please take care of the items you borrow and report any damage immediately. Though borrowers are responsible for the damage that they have caused, we promise not to be angry. If you feel compelled to return them in better condition than when you borrowed them, that would be highly appreciated!

Limitation of liability: please make sure you read this paragraph.

Share & Repair will not be liable for any loss or damage you may suffer whilst using the Library of Things or any item you borrow from the Library of Things. This does not include any liability which cannot be excluded (such as liability arising from death, personal injury caused by negligence, or fraud).

Any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms and conditions or any borrowing from the Library of Things is governed by, and will be construed in accordance with, the law of England and Wales.


Data protection and Privacy


Share & Repair will hold any personal data obtained from you in a manner consistent with its data protection obligations to you. A full description of these obligations and how we follow them is set out in our Privacy Policy.

We take the privacy of our members data seriously and 

will only use your personal information for administration purposes and for 

communicating with you about your membership and informing you about changes and new items available to borrow. Only the staff and volunteers will be able to access your information. We will never share or sell your data without your express permission.
